Injunction for Protection defense in Florida.

An injunction for protection is a Florida court order that can restrict contact, housing and firearm rights. This page walks through each stage, from the ex parte temporary order to the final hearing and afterward. Available 24 hours a day.

How does an injunction for protection work in Florida?

A person files a petition describing the conduct they say happened. A judge reviews it and can issue a temporary injunction without notice to the other person, often called an ex parte order. A full hearing is then held, generally within 15 days, where both sides can appear and the judge decides whether a final injunction should be entered.

Florida has more than one kind. Domestic violence injunctions are governed by F.S. 741.30, while injunctions for dating violence, repeat violence and sexual violence fall under F.S. 784.046. The type matters because each has its own requirements for the relationship and the conduct that must be shown.

Understanding the ex parte stage

An ex parte order is issued based on the petition alone, before the respondent has had a chance to answer. That does not mean the judge has made a final decision on the allegations. It means the court found the petition sufficient to put temporary protections in place until a hearing can be held.

While the temporary order is in effect, its terms must be followed. Violating an injunction is a crime, and that is true whether the order is temporary or final.

What happens at the final hearing

The final hearing is an evidentiary hearing before a judge. Each side can testify, call witnesses and offer documents such as messages or photographs. The judge decides based on the evidence presented at the hearing, not on the petition alone.

Sometimes a hearing is continued to a later date, and the temporary order may stay in effect in the meantime. Whether that happens depends on the court and the circumstances.

Consequences of a final injunction

A final injunction can affect where a person lives, contact with children and the right to possess firearms. How long it lasts depends on what the judge orders.

An injunction is also separate from any criminal case, even though the same events can lead to both. A criminal court can impose its own no contact conditions as part of release, and those run alongside whatever the injunction requires.

Questions about injunction for protection
Florida law allows a judge to issue a temporary injunction without notice when the petition supports it. This ex parte order provides temporary protection until a full hearing, which is generally held within 15 days. The respondent's opportunity to present evidence comes at that hearing.
They are based on different relationships and conduct. Domestic violence injunctions under F.S. 741.30 involve family or household members, while repeat violence injunctions under F.S. 784.046 address conduct between people who may not share that relationship. Each requires the petitioner to show the facts its statute calls for.
Either party can ask the court to modify or dissolve an injunction, generally by showing that circumstances have changed. Until the judge rules, the existing terms remain in effect. An agreement between the people involved does not change the order on its own.
