Where is a Brevard County DUI case heard?
Every DUI arrest in Brevard County, whether it happens in Melbourne, Palm Bay, Cocoa Beach or Titusville, is prosecuted in Florida's Eighteenth Judicial Circuit, which Brevard shares with Seminole County. The county's main courthouse is the Moore Justice Center in Viera, and court is also held in Titusville and Melbourne. Your court notice shows where each hearing is set.
A first or second DUI is usually a misdemeanor and is handled in county court. A third DUI within 10 years of a prior conviction, a fourth DUI, or a DUI involving serious bodily injury or death is a felony and is handled in circuit court, where both the process and the penalties are more serious.
Who makes DUI arrests on the Space Coast
Brevard has many separate police agencies. Inside city limits, arrests are usually made by city departments such as the Melbourne, Palm Bay, Cocoa, Titusville and Cocoa Beach police. In unincorporated communities like Viera and South Patrick Shores, the Brevard County Sheriff's Office handles enforcement, and the Florida Highway Patrol works I-95 and the state roads.
The agency matters because each one keeps its own reports, video and breath testing records. Requesting those records early is part of reviewing any Brevard case, whether the stop happened on A1A, US 1 or the interstate.
Two cases begin on the day of the arrest
A Brevard DUI arrest opens a criminal case in court and a separate administrative case about your driver license with the Florida Department of Highway Safety and Motor Vehicles. There are only 10 days from the arrest to request a formal review hearing on the license suspension. If no request is made in time, the suspension takes effect.
The two cases run on their own timelines. A result in one does not automatically settle the other, so each needs attention from the start.
