Three counties and two judicial circuits
Central Florida DUI cases do not all go to the same courthouse. Orange County and Osceola County make up Florida's Ninth Judicial Circuit. Seminole County belongs to the Eighteenth Judicial Circuit, which it shares with Brevard County.
In practice, an arrest in Orlando, Winter Park, Maitland or Apopka goes to the Orange County Courthouse in downtown Orlando. An arrest in Kissimmee goes to the Osceola County Courthouse. An arrest in Sanford, Lake Mary, Altamonte Springs, Oviedo or Casselberry goes to Seminole County's criminal courthouse in Sanford.
Arrests around Orlando, the theme parks and I-4
Arrests are made by city police departments such as the Orlando, Winter Park, Kissimmee and Sanford police, by the Orange, Osceola and Seminole County sheriff's offices in unincorporated areas, and by the Florida Highway Patrol on I-4 and the toll roads.
Central Florida also hosts millions of visitors. A DUI case is prosecuted in the county where the arrest happened, so a tourist stopped near the theme parks faces a Florida case even after returning home, and a Florida suspension can be reported to the driver's home state.
The 10 day license deadline
Every Florida DUI arrest starts an administrative license case with the Florida DHSMV alongside the criminal charge. You have 10 days from the arrest to request a formal review hearing. Without that request, the suspension takes effect.
The license case and the court case follow different rules and different calendars, which is why both are reviewed from the first call.
